Have some fun! Video quality doesn’t need to be perfect; you can film it with a high-quality production camera or your cell phone. Use claymation, drawings, visual effects . . . or any tactic that gets the point across. The goal is to portray CalChamber as the HR compliance expert and business advocate for all California employers, regardless of size or industry.

Here are some ideas to kick start your entry:
• You can promote how one of our products solves an HR issue or issues.
• Show how membership to CalChamber saves you time and money.
• Promote HRCalifornia, the Labor Law Helpline, Employee Handbook Creator, California Harassment Prevention training or focus on smaller components like wizards, forms, checklists and other tools.
• Show how CalChamber shines when it comes to understanding employment law in California.
• Focus on how CalChamber helps small, medium or large businesses.

Once your entry has been reviewed and posted by CalChamber, share your entry often.

Make no mistake, you are creating an advertisement for CalChamber. The message should be positive and communicate a solution or service that you know CalChamber delivers. Entries can be serious or humorous but all should demonstrate how a CalChamber product or service either solves a problem or makes your employment law compliance easier. All entries must comply with the Rules.

Even if you don’t win, we may use your ad.

CalChamber’s HR Shameless Plug Awards Contest (“HRSPA Contest”) is sponsored by CalChamber, 1215 K St. Suite 1400 Sacramento CA, 95814.
The HRSPA Contest is open to legal residents of the 50 United States and the District of Columbia, ages 18 & up. The HRSPA Contest is void where prohibited.

1. Binding Agreement: In order to enter the HRSPA Contest, you must agree to these Rules. Therefore, please read these Rules prior to entry to ensure you understand and agree. You agree that submission of an entry constitutes agreement to these Rules. You may not submit an entry and are not eligible to receive the prizes described herein unless you agree to these Rules. These Rules form a binding legal agreement between you and CalChamber with respect to the HRSPA Contest.

2. Video Requirements: All video submissions must:

1. Be an original video that mentions or portrays products and/or services from CalChamber, either from the CalChamber store or HRCalifornia, in a positive manner.
2. Include the CalChamber website address calchamber.com.
3. Be roughly 60 - 90 seconds in length. Video cannot exceed two minutes.
4. No background music should be used unless the music is your own original work. Sound effects are okay if they are not the intellectual property of a third party.
5. Must not contain material which is (or promotes activities which are) sexually explicit, obscene, pornographic, violent, discriminatory, illegal, offensive (offensive language, crude references or images, etc.) threatening, profane, and/or harassing. All videos must be tasteful.
6. All participants in the video must be 18 years of age or older. You must also have authorized permission to use any image, likeness, or voice of any third party used in the production of your video.
7. Must not violate or infringe another person’s rights, including but not limited to material that violates privacy, publicity or intellectual property rights, or that constitutes copyright infringement. Videos must not include third party products, trademarks, logos, insignia, location signage, photographs, artwork, images, or sculptures.
8. Be uploaded to CalChamber via the Facebook or contest page application and include “CalChamber HR Shameless Plug Awards Contest Entry” in title.
9. Comply with the YouTube Terms of Service located at http://www.youtube.com/t/terms and with the YouTube Community Guidelines located at http://www.youtube.com/t/community_guidelines.

3. Submission Period: The HRSPA Contest submission period commences at 12:00 p.m. Pacific Time (“PT”) on July 17, 2017 and ends at 11:59 p.m. PT on September 30, 2017 (the “Submission Period”).

4. Eligibility: The HRSPA Contest is open only to legal residents of the 50 United States and the District of Columbia, who are 18 years of age or older and located within the United States at the time of entry. The HRSPA Contest is void where prohibited by law. Employees, contractors, directors and officers of CalChamber and Sociamonials, their immediate family members (parent, child, sibling and spouse of each) and those living in the same household of each are not eligible.

5. How to Enter: THERE IS NO ENTRY FEE AND NO PURCHASE NECESSARY TO ENTER OR WIN. During the Submission Period, go to the contest page: http://calchamber.sociamonials.com/HR-Shameless-Plug-Awards/c886/ and locate the official entry form. Follow the on-screen directions to enter (“Online Entry”) and upload your video. Entrants must complete all required information including full name, title, company, current address, phone number, work email address and age. LIMIT ONE (1) ONLINE ENTRY PER PERSON PER E-MAIL ADDRESS PER DAY. For purposes of the HRSPA Contest, a day is defined as a 24-hour period beginning at 12:00 am PT and ending at 11:59 pm PT. Incomplete entries and entries submitted outside the Submission Period will not be posted nor judged. Once CalChamber has completed its initial review of the entry, it will be posted to YouTube and may be promoted on CalChamber’s other social media accounts. By entering the HRSPA Contest, you hereby grant CalChamber and Sociamonials, the application administering the HRSPA Contest, permission to display and share your entry.

6. CalChamber Discretion: CalChamber reserves the right in its sole discretion to review and qualify all entries and to reject any entry that does not comply with these Rules or is not consistent with the spirit and theme of the HRSPA Contest. In such a case, CalChamber will not post the entry and it will not be considered by the judges as eligible. CalChamber may, in its sole discretion, disqualify at any time any entry from the HRSPA Contest which CalChamber discovers violates these Rules or is inconsistent with the spirit and theme of the HRSPA Contest. The disqualified entry will be removed from the contest page and any other location it was posted by CalChamber. Moreover, the disqualified entry will no longer be eligible to be judged by the judging committee.

7. Winners:
1. A judging committee comprised of CalChamber employees will judge entries on the level of creativity, humor (if applicable), effective messaging and adherence to the Rules. The judges will select two (2) winners – a Grand Prize winner and a Runner-up. On, or about October 31st, 2017, CalChamber will announce the winners. Purchasing products or becoming a member of CalChamber will not increase your chance of winning.
2. The Grand Prize winner will receive a check for $1,500.00 and a HRSPA trophy. The Runner-up will receive a $500.00 Visa gift card. These prizes are being offered by CalChamber. Visa is neither a sponsor of this contest nor affiliated with this contest. PRIZES ARE PROVIDED “AS IS” AND WITHOUT ANY WARRANTY OF ANY KIND. No cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to availability and CalChamber reserves the right to substitute any prize with another of equivalent value without giving notice. The value of any prize awarded to a winner may be reported for tax purposes as required by law. The winners are solely responsible for reporting and paying all applicable taxes. CalChamber is not responsible for inaccurate prize details supplied to any entrant by any third party.
3. Winners will be notified by e-mail, mail or telephone. The winner may be required to sign and return an Affidavit of Eligibility and Release of Liability, a Publicity Release, and an IRS W-9 form within ten (10) days of notification. The return of any prize/prize notification as undeliverable or failure to respond to notices or return any document in a timely manner, as determined by CalChamber, may result in disqualification and an alternate winner may be chosen. Arrangement for delivery of the prize will be performed after winner validation.
4. Acceptance of a prize constitutes permission for the Sponsor and its agencies to use winners’ names and likenesses for purposes of advertising and publicity without further compensation, unless prohibited by law.
5. The winners’ names and videos will be posted on CalChamber’s website(s) calchamber.com.

8. Odds: Odds of winning a prize depend on the number of entries received. To find out the winners’ name, please send a stamped, self-addressed envelope to the following address: CalChamber, Attn: HRSPA Contest, 1215 K Street, Suite 1400, Sacramento, CA 95814, after October 31, 2017.

10. The HRSPA contest is in no way sponsored, endorsed or administered by, or associated with YouTube, Facebook, Twitter, LinkedIn, Pinterest or any other social network. By participating, you hereby release and hold harmless YouTube, Facebook, Twitter, LinkedIn and Pinterest from any and all liability associated with the HRSPA contest.

11. By participating, you (a) agree to be bound by these Rules, the decisions of the judges, and the decisions of CalChamber and its agents in all matters relating to the HRSPA Contest, which decisions shall be final in all respects; (b) grant CalChamber a non-exclusive, worldwide, perpetual, assignable, royalty-free license to publish, reproduce, distribute, display, perform, create derivative works, transmit or disseminate your entry in all media or platforms whether now known or hereafter invented (any use by CalChamber of your entry will be in CalChamber’s sole discretion and without any further consideration and/or attribution to you or any third party); (c) waive any and all moral rights in your entry with respect to any use by CalChamber; (d) represent and warrant that the entry submitted is your own work, does not violate the rights of any third party, and does not violate any federal, state or local law or ordinance; and (e) agree to release, indemnify and hold harmless CalChamber, its affiliates and their respective directors, officers and employees, from any and all claims, liabilities, losses, damages, costs or expenses of any kind whatsoever, including but not limited to the infringement of intellectual property rights of others, resulting in whole or in part from your participation in the HRSPA Contest or the acceptance and use of any prize.

12. CalChamber and its affiliates including all entities associated with the administration of the HRSPA Contest (“Contest Entities”) are not responsible for lost, late, misdirected entries or mail, or for error, omission, interruption, deletion, defect, delay in transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure by Contest Entities to receive entries for any reason whatsoever. Contest Entities are not responsible for any typographical or other error in the printing of the offer or administration of the HRSPA Contest.

13. If, in CalChamber’s sole opinion, the integrity of the HRSPA Contest has been impaired or corrupted for any reason, CalChamber reserves the right to void suspect entries and/or suspend and/or terminate the HRSPA Contest. In that event, CalChamber reserves the right, in its sole discretion, to select winners from among the eligible entrants legitimately received prior to the event causing cancellation or termination. In the event of a dispute regarding the identity of the person submitting an entry, entries will be declared made by the name appearing on the online entry form. CalChamber reserves the right, in its sole discretion, to disqualify any individual who tampers with or is suspected to have tampered with the HRSPA Contest or acts in a disruptive manner.

14. Governing Law: The HRSPA Contest is governed by and interpreted under the laws of the State of California exclusive of any choice of law or conflict of law rules.

15. Limitation of Liability: ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THE HRSPA CONTEST, BUT IN NO EVENT ATTORNEYS’ FEES, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

16. Arbitration: IN THE EVENT OF A DISPUTE BETWEEN YOURSELF AND CALCHAMBER, IT IS HEREBY AGREED THAT THE DISPUTE SHALL BE SETTLED BY BINDING ARBITRATION BY THE AMERICAN ARBITRATION ASSOCIATION (“AAA”) IN ACCORDANCE WITH THE AAA COMMERCIAL ARBITRATION RULES. THE ARBITRATOR’S DECISION SHALL BE FINAL AND BINDING AND JUDGMENT MAY BE ENTERED THEREON. YOU AGREE THAT SUCH ARBITRATION SHALL TAKE PLACE IN SACRAMENTO, CALIFORNIA AND HEREBY CONSENT TO PERSONAL JURISDICTION IN SACRAMENTO, CALIFORNIA. THE PARTIES FURTHER AGREE TO SHARE EQUALLY ALL ADMINISTRATIVE FEES AND THE ARBITRATOR'S FEES AND EXPENSES. ALL OTHER COSTS AND EXPENSES ASSOCIATED WITH THE ARBITRATION, INCLUDING, WITHOUT LIMITATION, ATTORNEYS' FEES AND RELATED COSTS, SHALL BE BORNE BY THE PARTY INCURRING THE EXPENSE. ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE HRSPA CONTEST OR ANY PRIZES AWARDED SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION.

17. Severability: If any provision of these Rules is held by an arbitrator or a court of competent jurisdiction to be invalid, void, or unenforceable, the remaining provisions shall nevertheless continue in full force and effect without being impaired or invalidated in any way.

18. Entire Agreement: These Rules contain the entire agreement between the parties on the subject matter herein and supersedes any prior or contemporaneous agreements and understandings, whether written or oral.

19. The HRSPA contest is being run on an app created by Sociamonials. Sociamonials is neither endorsing nor sponsoring this contest.

20. You agree and acknowledge that personal data submitted with an entry, including name, mailing address, email address, and phone number may be collected, processed, stored, and otherwise used by CalChamber and Sociamonials for the purpose of conducting and administering the HRCA Contest. In addition, all personal information that is collected will be used by CalChamber in accordance with the following Privacy Policy located at: http://www.calchamber.com/aboutus/Pages/privacypolicy.aspx.
